What is Personal Information?
We define "personal information" as your first and last name, your email address, your home or other physical address, your telephone number, your social security number, or any other identifier that permits ARCADE to contact a natural human person, like you, and/or any information that ARCADE maintains that could be used to identify you in combination with any of the identifying information described above.
What Personal Information Does ARCADE Collect?
Information from you. ARCADE receives and stores any information you choose to post on or provide through the Sites, for example when you register for the ARCADE newsletter, subscribe to the ARCADE magazine or purchase individual print issues, request information or provide information in any other manner. This includes personal information you provide, such as your name or email address.
Cookies and Web beacons. ARCADE also automatically receives and stores certain types of information whenever you visit the Sites, such as the name of the domain and host from which you access the Internet, the IP address of the computer you are using and the browser and operating system you are using. ARCADE uses "cookies" to automatically gather some of this information. A "cookie" is a small text file that the Sites send to your computer to collect information about your activities on the Sites. The cookie transmits this information back to the Sites each time your browser requests a page from the Sites, and the information is stored to help facilitate your use of the Sites the next time you visit. You can set your browser to not accept cookies if you choose, but then you might not be able to access or use certain portions of the Sites.
If you want to view, delete or modify your personal information, you may do so in accordance with our Correction/Update Procedure.
How Does ARCADE Use Personal Information?
ARCADE uses the information you provide and we collect to administer, maintain and improve the Sites and operation of each Site; verify your identity and respond to your requests for information; comply with applicable laws, statutes and regulations; enforce the Terms, this Policy and ARCADE's rights and the rights of others; as specifically provided in the Terms and as you may otherwise agree – for example, if you sign up for newsletters, we will use your personal information to provide you with the newsletters.
To Whom Does ARCADE Disclose Personal Information?
ARCADE does not share your personally-identifiable information with third parties, except as described below and as otherwise specified in this Policy. ARCADE may share your personal information as follows:
- With third parties that perform functions on ARCADE's behalf, such as maintaining the Sites or processing payments made through the Sites;
- As ARCADE believes necessary to comply with laws, statutes or regulations or to enforce the Terms and to protect our rights and the rights of other persons;
- As required by a court or government agency or to respond to a claim by you or a third party;
- As part of a transfer of ARCADE's assets, for example as part of a merger with another nonprofit entity;
- As you have otherwise agreed or requested.
In addition, ARCADE may respond to any subpoena received from a government agency without prior notice to you. Unless prohibited by law or by a court order, ARCADE will use reasonable efforts to notify you of any subpoena received from another party (e.g., for civil litigation) that requires ARCADE to disclose your identity, and will wait ten (10) days, or a lesser amount of time as required by the deadline in the subpoena, before providing the requested information.
The Sites are not directed at children, and ARCADE will not knowingly collect personally identifiable information from any child under age 13. Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will not knowingly request or collect personal information from any child under age 13 without obtaining the required parental consent. Children can browse the Sites without any personal information being collected. The Sites may contain links to other websites. We do not control, and make no representations whatsoever regarding, such other websites or the products and services offered by or through websites accessed through links on the Sites, even those with which we may have an affiliation. If you decide to access third party websites linked through the Sites you do so at your own risk, and subject to the policies and terms of such websites.

By providing your email address to ARCADE through the Sites, you affirmatively and expressly consent to receiving commercial emails from ARCADE. You may also choose to opt-out of receiving our newsletter or other emails by contacting us as provided above.
ARCADE reserves the right to verify the identity of any person making such a request; provided, however, that ARCADE shall have no liability of any kind resulting from false or erroneous requests or any change or deletion made by ARCADE for any reason. Personal information collected and transferred to back-up or archival storage may be retained indefinitely. ARCADE may also retain unmodified information as necessary for business records and as required under applicable law.
ARCADE has reasonable security measures in place to protect information under ARCADE's control against unauthorized access or use, but cannot ensure and does not warrant the security of any information or data. Communication via the Internet is not failsafe, and there is always the possibility that data may be lost, or intercepted by unauthorized parties, during transmission or after receipt. You agree that ARCADE shall have no liability in connection with any lost or intercepted data or information.
Conditions of Use
Your access and use of the Sites are subject to this Policy and the Terms, including limitations on damages and the applicability of the law of the State of Washington.
