PRIVACY POLICY

This Privacy Policy (the "Policy") applies to all information learned about or obtained from you when you visit our arcadenw.org and arcadenw.squarespace.com websites (the "Sites"), whether you access the Sites through a personal computer, mobile device or any other technology. The Sites are owned and operated by Northwest Architectural League, dba ARCADE, a Washington nonprofit entity ("ARCADE," "we," "us," or "our"). This Privacy Policy applies whether you access the Sites through a personal computer, mobile device, or other device.

Together with our Terms of Use (the "Terms"), this Policy is a legally binding agreement between you and ARCADE. By accessing or using the Sites, you consent to the Terms and the Policy, including our collection, use, and disclosure of your personal information as provided below. ARCADE may modify the Policy from time to time, effective upon posting to the Sites. Your access to or use of the Sites at any time constitutes acceptance of the Policy in effect at that time.

What is Personal Information?

We define "personal information" as your first and last name, your email address, your home or other physical address, your telephone number, your social security number, or any other identifier that permits ARCADE to contact a natural human person, like you, and/or any information that ARCADE maintains that could be used to identify you in combination with any of the identifying information described above.

What Personal Information Does ARCADE Collect?

Information from you. ARCADE receives and stores any information you choose to post on or provide through the Sites, for example when you register for the ARCADE newsletter, subscribe to the ARCADE magazine or purchase individual print issues, request information or provide information in any other manner. This includes personal information you provide, such as your name or email address.

Purchases and payment information. If you pay for any product or service via the Sites, the transaction will be handled by our service vendor responsible for processing your payment ("Payment Processor"). This entity has its own privacy policy which will apply to you. Please be sure to review them at the links provided during payment processing. The policy of the Payment Processor is also considered a part of this Privacy Policy and part of your agreement with us. We will require your payment or credit card information in order for the Payment Processor to process purchases. This includes your name, payment or credit card number, expiration date, billing address, and authentication codes or related information as needed to authorize the charge and complete the transaction. Payment or credit card data is transferred over a Secured Sockets Layer (SSL) line if you are using a SSL enabled browser such as Microsoft Internet Explorer, Firefox, Safari, or Google Chrome.

Cookies and Web beacons. ARCADE also automatically receives and stores certain types of information whenever you visit the Sites, such as the name of the domain and host from which you access the Internet, the IP address of the computer you are using and the browser and operating system you are using. ARCADE uses "cookies" to automatically gather some of this information. A "cookie" is a small text file that the Sites send to your computer to collect information about your activities on the Sites. The cookie transmits this information back to the Sites each time your browser requests a page from the Sites, and the information is stored to help facilitate your use of the Sites the next time you visit. You can set your browser to not accept cookies if you choose, but then you might not be able to access or use certain portions of the Sites.

If you want to view, delete or modify your personal information, you may do so in accordance with our Correction/Update Procedure.

How Does ARCADE Use Personal Information?

ARCADE uses the information you provide and we collect to administer, maintain and improve the Sites and operation of each Site; verify your identity and respond to your requests for information; comply with applicable laws, statutes and regulations; enforce the Terms, this Policy and ARCADE's rights and the rights of others; as specifically provided in the Terms and as you may otherwise agree – for example, if you sign up for newsletters, we will use your personal information to provide you with the newsletters.

To Whom Does ARCADE Disclose Personal Information?

ARCADE does not share your personally-identifiable information with third parties, except as described below and as otherwise specified in this Policy. ARCADE may share your personal information as follows:

  • With third parties that perform functions on ARCADE's behalf, such as maintaining the Sites or processing payments made through the Sites;
  • As ARCADE believes necessary to comply with laws, statutes or regulations or to enforce the Terms and to protect our rights and the rights of other persons;
  • As required by a court or government agency or to respond to a claim by you or a third party;
  • As part of a transfer of ARCADE's assets, for example as part of a merger with another nonprofit entity;
  • As you have otherwise agreed or requested.

In addition, ARCADE may respond to any subpoena received from a government agency without prior notice to you. Unless prohibited by law or by a court order, ARCADE will use reasonable efforts to notify you of any subpoena received from another party (e.g., for civil litigation) that requires ARCADE to disclose your identity, and will wait ten (10) days, or a lesser amount of time as required by the deadline in the subpoena, before providing the requested information.

Children

The Sites are not directed at children, and ARCADE will not knowingly collect personally identifiable information from any child under age 13. Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will not knowingly request or collect personal information from any child under age 13 without obtaining the required parental consent. Children can browse the Sites without any personal information being collected. Third Party Links

The Sites may contain links to other websites. We do not control, and make no representations whatsoever regarding, such other websites or the products and services offered by or through websites accessed through links on the Sites, even those with which we may have an affiliation. If you decide to access third party websites linked through the Sites you do so at your own risk, and subject to the policies and terms of such websites.

By providing your email address to ARCADE through the Sites, you affirmatively and expressly consent to receiving commercial emails from ARCADE. You may also choose to opt-out of receiving our newsletter or other emails by contacting us as provided above.

ARCADE reserves the right to verify the identity of any person making such a request; provided, however, that ARCADE shall have no liability of any kind resulting from false or erroneous requests or any change or deletion made by ARCADE for any reason. Personal information collected and transferred to back-up or archival storage may be retained indefinitely. ARCADE may also retain unmodified information as necessary for business records and as required under applicable law.

Security

ARCADE has reasonable security measures in place to protect information under ARCADE's control against unauthorized access or use, but cannot ensure and does not warrant the security of any information or data. Communication via the Internet is not failsafe, and there is always the possibility that data may be lost, or intercepted by unauthorized parties, during transmission or after receipt. You agree that ARCADE shall have no liability in connection with any lost or intercepted data or information.

International Visitors

The Sites are hosted in and provided from the United States. If you use the Sites from the European Union ("EU"), or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States. The United States does not have the same data protection laws as the EU, and some other regions. By providing your personal information, you consent to the transfer of your personal information to the United States and the use of your personal information, in accordance with this Privacy Policy.

Conditions of Use

Your access and use of the Sites are subject to this Policy and the Terms, including limitations on damages and the applicability of the law of the State of Washington.
